US electric vehicle (EV) giant Tesla has filed a complaint against a Gurugram-based firm, accusing it of infringing on its trademark. In the complaint filed in the Delhi High Court, Tesla argued that a Gurgaon-based battery seller Tesla Power India infringed on its trademark.  It claimed that Tesla Power not only shares a similar trademark name but also advertises as an EV company in newspapers.

Tesla argued that the battery seller's use of the trademark in India was causing confusion among consumers and potentially harming its business interests.

According to Tesla, consumers are mistakenly purchasing batteries from Tesla Power batteries assuming it to be from the EV maker and registering complaints with them, in case of faulty products.

Citing these, Tesla sought urgent action against Tesla Power's use of the Tesla trademark, arguing that it could damage the EV maker's brand and ongoing business activities in India.

What is Tesla Power?

Tesla Power, on the other hand, argued that it is not manufacturing EV batteries but rather selling lead-acid batteries used in conventional vehicles and inverters.

According to Tesla Power, it has been selling batteries since 2020 and has 1 million customers in India.

Tesla Power also clarified the advertisement featuring the Tesla trademark was related to another company, e-Ashwa, with whom they have a strategic partnership to sell branded products. 

No ads till May 22: HC

The Delhi High Court which accepted the EV maker's plea restrained Tesla Power from publishing any promotional advertisements featuring EV products with a similar Tesla trademark till May 22.

The court, however, noted that Tesla had not shown any urgency in the matter as it had been communicating with Tesla Power since 2020 over the alleged illegal use of its trademark.

The trademark case comes at a time when there are rumors about an imminent India entry of Tesla.
